The non-EU property tax — what you actually need to know

You may have seen alarming headlines about Spain planning a "100% tax" on foreign property buyers. The reality is significantly more nuanced — and for many of our clients, it's not relevant at all. Here's a clear, honest breakdown.

Current status: A proposal — not law As of April 2026, this tax has not been passed by the Spanish parliament. It remains a draft bill under debate, and many legal experts doubt it will pass in its current form due to parliamentary and constitutional hurdles.

Who is exempt from this tax

  • 🇬🇧British buyers moving full time — once you obtain Spanish residency (a residencia), you are fully exempt, regardless of nationality
  • 🇪🇺EU nationals — Germans, French, Dutch, Scandinavians with EU passports are completely unaffected
  • 🏗️New-build buyers — new-build purchases are subject to VAT, not Transfer Tax, so this extra charge does not apply
  • 📄Business purchasers — deals already subject to VAT are also exempt

  • 🏖️British second-home buyers who remain non-resident (spending fewer than 183 days per year in Spain and paying tax in the UK)
  • 🌍Non-EU investors — Americans, Canadians, Australians and others outside the EU who are non-resident in Spain
  • 🏠Resale property buyers only — the tax applies to second-hand properties, not new builds

What does "100% tax" actually mean?

The headline is misleading. It is not a tax equal to 100% of the property price. It is a 100% increase in the Transfer Tax (ITP) rate — meaning the existing rate is doubled. In the Canary Islands, the Transfer Tax is currently 6.5% for most properties.
